Namaste :), today, come along, let’s take a walk around the mediation lounge area.

A few self-reflective questions before you go ahead:

  • How important do you consider the ambiance of the mediation lounge area to be in facilitating productive discussions?
  • To what extent does the layout of the lounge area impact your perception of the mediation process?
  • How much thought have you given to the design and aesthetics of the mediation lounge area?
  • Do you believe that the amenities available in the mediation lounge area contribute to a positive negotiation environment?
  • In your opinion, how does the atmosphere of the mediation lounge area influence the overall mediation experience?

And you are welcome to read herewith the sharing from my observations at one of the mediation lounge areas:

In the quiet anticipation of the mediation lounge, I couldn’t help but observe how the choice of chair can speak volumes about each party’s personality and disposition.

My eyes couldn’t help but wander to the chairs each party had chosen for themselves. It was like a silent commentary on their personalities (or exterior traits — please note that exterior traits can be temporary and may fluctuate based on the circumstances they face).

Instant words in my head around this time were: (subtle yet profound revealing layers of) ——power dynamics, comfort preferences, and levels of authority.

One team gravitated towards the sturdy, high-backed chairs, exuding an aura of power and hierarchy. These individuals seemed to seek dominance and control, perhaps reflecting a reluctance to yield in negotiations.

The other team settled into plush, cushioned seats, embracing comfort and relaxation. Their choice hinted at a desire for ease and tranquility, suggesting a willingness to engage in a more amicable resolution.

Well, can’t blame the other team for seeking comfort in what might be a stressful situation, no?

Among all of them who had arrived, some opted for chairs positioned at the center of the room, projecting a sense of responsibility and leadership. These individuals (appeared to be the counsels/lawyers to the parties) appeared ready to take charge and guide the proceedings.

In contrast, a few chose (they sure were the interns/ research assistants to the lawyers) modest, unassuming seats along the periphery, embodying humility and obedience. Their demeanor suggested a readiness to listen and cooperate, prioritizing harmony over assertion.

Some of the supporting team members of the parties there were also those who seemed transient, perched on the edge of their chairs as if they were only passing through. Their fleeting presence hinted at a lack of permanence, perhaps indicating a hesitancy to fully commit to the mediation process. True this is, because the supporting team members were not welcome to the mediation rooms, but they continued to wait in the lounge area.

But hey, it’s not just about the chairs!? The waiting area does more than just provide a spot to chill before the main event, no? It sets the vibe for the entire mediation. It’s where parties adjust/ regulate from their hectic outside world to the calm of the mediation room.

The mediator in me had by now, realized the super-importance of the waiting area in setting the tone for the upcoming uncomfortable dialogues.

Indeed, the art of mediation extended beyond the dialogue table, encompassing the delicate orchestration of every interaction and gesture, from the moment parties arrived at the venue. As the mediator, it was my job to make sure that transition would be as smooth as butter.

After all, creating the right atmosphere can make or break the whole mediation game! What say?
