When you think about dialogue, dear reader, what comes to mind? A conversation over coffee? A heated debate? A movie dialogue? Or perhaps a heart-to-heart moment with someone close?
Here, we proceed to think of a dialogue in a mediation session. Now imagine this: you’ve entered a mediation session, ready to untangle a complicated issue. Everyone is gathered— people in mediation, team of counsels helping people in mediation and the mediator—and there’s an air of anticipation. But then, the process halts because someone lacks the authority to make a decision.

This comic above captures that exact scenario. In one such mediation facilitated, a father brought his three sons together to discuss the distribution of family property and the business he had built over decades. He wanted to ensure transparency, clarity, and, most importantly, avoid future conflicts among the siblings, and therefore— A dialogue through Mediation!
Two of the sons were ready to engage fully, with the authority to decide and consent on their family’s behalf. However, the youngest son hit pause. He needed time to consult with his wife and children before agreeing to anything. While it’s important to take family input into account, this delayed the mediation process and left everyone at a standstill.
Recognizing this challenge, the mediator navigated the situation by creating time and space for the youngest son to consult his family. This thoughtful approach allowed everyone to regroup and reconvene with clarity, leading to an amicable decision that respected all perspectives.
Yes, Authority!
When you attend a mediation, knowing whether you have the authority to make decisions is crucial.
A mediator will always ask each participant about their authority early in the process. If someone lacks this authority, declaring it openly allows the mediator to adapt the conversation journey accordingly, ensuring that everyone’s role and influence are accounted for.
This simple yet significant detail can shape the outcome of the entire discussion.
